Withthecreationofthecurrent Penal Execution Law (nº 7.210), educationalassistance for prisonersandinterneesofficiallybecame a strategyaimedatcontributingtothereturnoftheseindividualstosociety, thanksto its “reforming” character. The Brazilianprison system, however, hascharacteristicsthatmake it difficulttoenforcethisright – a scenariothatiseven more complex in the case ofaccesstohighereducation. Weaimedtoresearch a briefcontextualizationoneducationalassistance in theprison system of Pernambuco, discussingthemainaspectsthatinfluencetheaccessoftheincarceratedpopulationtohighe reducationat a distance, andanalyzingthreeexperiencesthatcancontributetoindicatingpossiblewaysto improve therighttoHigherEducationawayfromthispopulation. For this, a narrativebibliographicreviewwillbecarried out onthesubject, alsomobilizing data presentedbyofficialbodiesandrelevantlegislation. The studywillcarry out semistructured interviews toanalyzethelegislativeadvancesandtheparticularitiesofeachPrison Unit andthecircumstancesexperiencedbypeopledeprivedoflibertytobeableto continue theirstudies, mainlyDistanceHigherEducation. The infrastructureconditionsandcontradictionsinherenttotheprison system willalsobeelementsanalyzedwheninterviewingthe managers oftheExecutiveSecretariat for Resocialization - SERES, marking out whatcontributestothisscenario, harmingorfavoringtheeffectivenessoftheeducationalassistanceprovided for bylawandtheaccessofthepopulationlockedintohighereducation. At theend, observe thesepilotprojects, developed in Pernambuco, andindicatepossiblewaystoovercomeatleast some oftheseobstacles.
